Terms and Conditions for ART 77 Gallery

1. Introduction 

Welcome to ART 77 Gallery ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the website located at https://www.art77gallery.com (the "Site"), operated by ART 77 Gallery Pte Ltd, a Singapore-incorporated company. By using or accessing the Site, you agree to these Terms. 

2. Eligibility 

You must be at least 18 years old or have reached the age of majority in your jurisdiction to make a purchase. By placing an order, you represent that you meet this requirement. 

3. Purchases 

  1. Artwork Listings: The Site provides information on available artworks, including pricing and descriptions. All prices are listed in the currency indicated, which may vary. 
  2. Order Process: Once you place an order, you will receive an order confirmation email. We reserve the right to accept or reject any order in our sole discretion. 
  3. Payment: Payments are processed via our third-party payment processors. You agree to provide valid and updated payment information. By submitting payment details, you consent to charges for the total amount of your purchase, including any applicable taxes, shipping costs, and fees. 

4. Shipping 

  1. Fulfillment: Artwork is shipped directly from the artist to the customer. We provide shipping estimates based on a FedEx integration on our Site. 
  2. Additional Costs: Shipping costs displayed at checkout are estimates. Actual costs may differ from initial estimates due to factors such as packaging requirements, destination fees, or courier surcharges. Any additional costs or duties are your responsibility. 
  3. Delivery Timeframe: Delivery times may vary based on location and customs processing. We are not liable for delays beyond our reasonable control. 
  4. Risk of Loss: Title and risk of loss for any purchased items pass to you upon the carrier’s delivery. 

 5. Returns and Refunds 

  1. Return Policy: If you wish to return an artwork, you must notify us within 3 days of receipt. Returns are subject to our discretion and may not be available for custom or commissioned pieces. 
  2. Shipping Responsibility: You are responsible for arranging and covering the cost of return shipping, including insurance. We recommend using a trackable shipping service. 
  3. Condition of Returned Artwork: Returned artwork must be in its original condition, without damage. 
  4. Refund Processing: Refunds (if approved) will be processed within 14 business days upon receipt and inspection of the returned item. Shipping fees are non-refundable. 

6. Intellectual Property 

All content on the Site, including but not limited to images, text, graphics, logos, and designs, is the property of ART 77 Gallery Pte Ltd or its licensors and is protected by applicable intellectual property laws. 

7. Limitation of Liability 

To the fullest extent permitted by law, ART 77 Gallery Pte Ltd and its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or purchase of any artwork. 

8. Indemnification 

You agree to indemnify and hold harmless ART 77 Gallery Pte Ltd, its affiliates, employees, and agents from any claim, demand, or damages arising out of or related to your breach of these Terms or violation of any applicable law or regulation. 

9. Governing Law and Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Singapore. 

10. Changes to These Terms 

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Site. By continuing to use the Site after changes are posted, you accept the modified Terms.
